Terms and Conditions ROSEN Data Games

1 Subject of the terms and conditions and organizer

  1. These terms and conditions regulate the conditions for participation in the competition and any necessary transfer of rights. The description and the procedure of the respective competition are carried out within the framework of the ROSEN Data Games at https://dataevaluation.rosen-group.com/en/rosen-data-games
  2. The competition is organized by ROSEN Technology and Research Center GmbH, Am Seitenkanal 8 in 49811 Lingen (Ems), represented by Managing Director Carlos Enrique Sabido Ponce.
  3. By participating in the respective competition, these conditions of participation are accepted.
  4. The contact and responsible party is ROSEN Technology and Research Center GmbH.

2 Participation

  1. Anyone over the age of 18 and resident in Germany is eligible to enter the competition. Participation with fake identities or identities of third parties is not permitted.
  2. Eligible participants can take part in the competition by entering the correct solution to one of the three mini-games on the landing page https://dataevaluation.rosen-group.com/en/rosen-data-games and submitting their valid registration.
  3. Participation is possible from August 1, 2023.

3 Prizes and notification of winnings

  1. All eligible participants will be entered into a monthly prize draw to win a voucher worth €50 for the Barneby games bar (Görlitzer Str. 11, 01099 Dresden).
  2. The winners will be randomly selected each month from all eligible participants who have entered the correct solution, contacted and announced via the social networks Instagram and Facebook. In addition, the winner will be notified by email, in which the winners will also be asked to provide us with their personal data correctly and truthfully by email. This information will be used to send the prize.
  3. If we do not receive a response from a winner within the period specified in the prize notification, the claim to the prize expires. In this case, we are entitled to carry out a replacement draw.
  4. Each participant can only win one prize per month.
  5. The prize is not transferable, nor can the prize be exchanged or paid out in cash.
  6. If circumstances arise for which we are not responsible, the respective winner will accept an appropriate replacement prize. Such circumstances for which we are not responsible are in particular those that lie with the sponsors of the prizes.
  7. The prizes will be awarded to the winners in consultation with the owner of Spielebar Barneby. For this purpose, we will send the winners' contact details to Spielebar Barneby so that all further coordination can be carried out by the latter. The risk is transferred to the winner when the prize is handed over to a carrier. We are not responsible for delivery damage.

4 Granting of rights of use

By accepting the prize, the winner agrees that we may use his/her name for advertising purposes.

5 Liability

  1. By handing over the prizes, we, our employees and representatives are released from all possible obligations arising from this competition. We are only liable for intent and gross negligence. This does not apply to injury to life, limb or health or to claims under the Product Liability Act. In the event of simple negligence, we shall only be liable if a material contractual obligation has been breached. In this case, liability is limited to the typically foreseeable damage.
  2. In accordance with Clause 5.1, we accept no liability for damages that may arise in connection with the acceptance of the prizes and/or in their aftermath. Furthermore, we do not assume any costs that the winners may incur as a result of accepting or redeeming the respective prize.
  3. We have no control over the internet and communication networks and are not liable for any problems caused by technical failures. We are not liable for fraud by third parties or for events beyond our control, including but not limited to user error and network, computer, hardware or software failures of any kind that may limit, delay or prevent participation in this competition.

6 Exclusion

  1. Any violation of these conditions of participation entitles us to exclude the respective participant from participation. This applies in particular if the participant provides false information.
  2. If the excluded participant is a winner who has already been drawn, the prize may be subsequently revoked.

7 Early termination and changes

We reserve the right to prematurely terminate, shorten or change the course of the competition in whole or in part at any time, even without observing deadlines, if it is not possible to guarantee the proper execution of the competition for technical (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons.

8 Data protection

We are responsible for the collection, processing and use of participants' personal data insofar as we process it ourselves. We will only use the personal details of participants and other personal data in accordance with the statutory provisions of data protection law. We will only store, process and use the information to the extent that this is necessary for the execution of the competition or if the participants have given their consent. This also includes use for exercising the rights of use granted. The data will only be used to carry out the competition and will then be deleted.
Participants can request information about the personal data stored about them at any time. Otherwise, our privacy policy applies accordingly, which is available at https://www.rosen-group.com/en/global/privacy-policy.

9 Final provisions

  1. Should the conditions of participation contain invalid provisions, this shall not affect the validity of the remaining conditions.
  2. German law applies.
  3. Legal recourse is excluded.
